Terms & Conditions – Vestima Dublin

Article 1 – Definitions

Within these terms and conditions, the following definitions apply:

Right of withdrawal: the period during which the consumer may exercise their right to cancel the agreement.
Consumer: a natural person who is not acting in the course of a business or profession and who enters into a distance contract with the company.
Long-term contract: a distance contract for a series of products or services, where delivery and/or obligations occur over time.
Right of withdrawal: the consumer’s ability to withdraw from the contract within the legal withdrawal period.
Company: the natural or legal person offering products or services to consumers at a distance.
Distance contract: a contract concluded between the company and the consumer via an organised system for distance selling.
CESOP: the Central Electronic System of Payment information introduced by the EU to monitor payment service providers.

Article 3 – Scope

These terms and conditions apply to every offer made by the company and to every distance contract between the company and the consumer. Before the agreement is finalised, the terms and conditions are made available electronically or in another accessible form.


Article 4 – The Offer

• All offers are non-binding. The company reserves the right to modify offers.
• Each offer clearly states the total price, including shipping costs, import duties, and any additional charges applied by postal or courier services.


Article 5 – Formation of the Agreement

The agreement is concluded once the consumer accepts the offer and meets the required conditions. The company will confirm the agreement electronically without delay.


Article 6 – Right of Withdrawal (Ireland & EU Law)

• The consumer has the right to withdraw from the agreement within 14 days from the date of receipt of the goods, without providing any reason.
• The cost of returning the product is borne by the consumer.


Article 7 – Effects of Withdrawal

The company will refund all payments received within 14 days after the returned product has been received, provided that the item is returned in its original condition.


Article 8 – Customs, Import Duties and VAT Responsibilities

8.1
All products are shipped under the term Delivered Duty Unpaid (DDU) according to Incoterms 2000. The customer is fully responsible for any import-related costs in Ireland.

8.2
These obligations include, but are not limited to:
(a) payment of customs duties, VAT, or other government taxes
(b) customs clearance fees, brokerage, inspection, or handling fees imposed by couriers or customs
(c) compliance with Irish import laws, certifications, and regulations

8.3
The company does not act as the importer. Ownership and responsibility transfer to the customer upon dispatch. The company is not liable for delays, seizures, or penalties resulting from the customer’s failure to comply with local import rules.

8.4
The company provides necessary commercial documents (such as invoices and product descriptions), but does not guarantee that these documents fulfil all import requirements. The customer must verify compliance.

8.5
The customer indemnifies the company for any financial consequences, claims, or penalties arising from non-compliance with Irish import regulations.

Customers are strongly advised to contact Irish Customs in advance to avoid unexpected charges.


Article 9 – CESOP Compliance

From 2024, EU payment service providers record transaction information in the CESOP system. The company complies with these regulations, which may affect the monitoring of payments.


Article 10 – Conformity and Warranty

• The company guarantees that products comply with the contract and applicable Irish and EU consumer laws.
• Any defects must be reported in writing within 30 days of discovery.
• Products being returned must be in their original packaging and condition.


Article 11 – Delivery

• Orders are delivered within 30 days, unless otherwise specified.
• If a delay occurs, the customer will be informed within 14 days.
• Delivery is carried out under conditions where the customer is responsible for import duties.
• The company is not responsible for delays caused by Irish Customs or courier inspections.
• Failure to meet import obligations does not entitle the customer to cancellation or refund.


Article 12 – Complaints Procedure

• Complaints must be submitted in writing within 7 days of discovery.
• The company will respond within 14 days. If more time is required, the customer will be notified.


Article 13 – Disputes

These terms and conditions are governed by Irish law.
Disputes should first be resolved amicably. If this is not possible, the dispute will be submitted to the competent courts in Ireland.
